Ask Your Members of Congress to Update the Electoral Count Act of 1887
The Electoral Count Act (ECA) of 1887 sets out the process of casting and counting electoral votes after a presidential election. Unfortunately, the language of the ECA is confusing and outdated. Partisan actors attempted to exploit the vulnerabilities of the ECA on January 6, 2021 to stop the counting of the electoral votes. While this attempt failed, we must ensure that the ECA is clarified and strengthened prior to the next presidential election.
Thankfully, a bipartisan group of senators introduced a bill called the Electoral Count Reform and Presidential Transition Improvement Act to modernize this law. This bill clarifies that the vice president’s role in counting electoral votes is only ministerial, establishes a clear process to identify a conclusive slate of electors for each state, and removes ambiguities in the law that could be used to override a state’s popular vote.
Please join us in asking Congress to pass the Electoral Count Reform Act as soon as possible. There is a large group of cosponsors to this bill who we would like to thank for their support. We would also like to ask the remaining senators to support passage of this bill into law.
